In the case of a section 211 works to trees in a conservation area notice, there is only 1 of 2 options for the Local Planning Authority (LPA). Allow the works to go ahead as described in the accompanying paperwork or serve a Tree Preservation Order (TPO). This prevents any works being carried out without the express written consent of the LPA.
LPA's must be able to show that a reasonable degree of public benefit would accrue before TPOs are made or confirmed and it should be in the interests of public amenity.
It is not possible to refuse or grant consent to a works to trees in a conservation area notice or apply a condition to a decision.
The trees are set back from the road frontage and thus have limited merit as a public visual amenity. I am not concerned, therefore, that the works will detract from the character of the conservation area or its enjoyment by members of the public.

Accordingly, it is my recommendation that it would not be in the interests of amenity to serve a TPO in this case and that the works be carried out as described in the accompanying paperwork.
