In the case of a section 211 works to trees in a conservation area notice, there is only 1 of 2 options for the Local Authority (LA). Allow the works to go ahead as described in the accompanying paperwork or serve a Tree Preservation Order (TPO). This prevents any works being carried out without the express written consent of the LA.

LA's must be able to show that a reasonable degree of public benefit would accrue before TPOs are made or confirmed and it should be in the interests of public amenity.

It is not possible to refuse or grant consent to a works to trees in a conservation area notice or apply a condition to a decision.

The tree is small with limited merit as a visual amenity. I am not concerned therefore that the proposed works will impact greatly on the character of the conservation area or its enjoyment by members of the public.

On this basis, it is my recommendation that it would not be appropriate to serve a TPO and that the works may go ahead as described in the accompanying paperwork
